are the luggage racks for the 800 and the 1500 diferent or are they interchangable

From what I have learned over the years, the answer is no they are not interchangeable. Racks for the 800 have always been a bit of a problem.

are the luggage racks different from year to year, the reason for asking is that I have a rack that came with my 1999 1500 but barely clears the top of the rear fender on bumps, my buddies 05 1500 he has ample clearence
there is one for sale on the net for 100$ kinda want to know if it fits

They aren't supposed to be, but Kaw has changed products and maintained the same part numbers. Some 99 owners have reported problems. Assuming the bikes are set up the same way, you can compare brackets to see if there is a difference. Could be something different in your setup compared to his as well. And, Drifters make a lot of changes to parts to get them to fit... so there are some non-standard setups out there!
